Citizenship for children born in camps for refugees: special order of the Madras High Court.

In case Sri Lankan Tamils who were born in refugee camps want to petition for citizenship, the Madras High Court has mandated that the federal government examine their application and make a decision in line with the Citizenship Act.

Chennai-based attorney Ravikumar petitioned the Madras High Court, arguing that Tamil Nadu residents from Sri Lanka ought to be mandated to give Indian citizenship to offspring born in camps for refugees. 59,500 of the 94,000 refugees who fled Sri Lanka and arrived in India are housed in camps.

Since the children residing in these camps lack access to school and career opportunities, the plea to provide Indian citizenship to children born in the camps for refugees has remained unanswered.

I've submitted a petition to the National Human Rights Commission asking them to take into account giving Indian citizenship to kids born in Tamil refugee camps in Sri Lanka. The Union Ministry of Home Affairs responded by stating that not all children born in refugee camps are eligible to apply for citizenship.

In this instance, on December 14, 2022, an order was issued by the Union Ministry of Home Affairs stating that citizenship is not granted to illegal immigrants who do not possess the necessary travel documents. In the petition, it was requested that the federal government revoke this directive and give citizenship to children born in Tamil Nadu's camps for refugees.

A court made up of Justice Bharatha Chakraborty and Chief Justice Gangapurwala heard the case on Thursday. The petition is open to the public, declared the judges hearing the case. filed without the campers' specifics. They declared the case closed, directing that the Citizenship Act be applied to any citizenship applications made by those born in the camps.
